Notice regarding the endorsements for the classification of workplaces under special working conditions for workers in the nuclear field

Endorsements for the classification of workplaces under special working conditions for workers carrying out their activity in the nuclear field

1. Pursuant to the provisions of Art. 29 (11) of Law no. 263/2010 on the unitary public pension system, as subsequently amended and supplemented, as amended and supplemented by Government Emergency Ordinance (GEO) no. 70/31.08.2023 amending and/or supplementing certain regulatory acts in the field of public pensions, the endorsements for workplaces under special working conditions whose validity was extended until 1 September 2023 remain valid without a new endorsement having to be issued.

2. Accordingly, the provisions of Art. I para. (1) of GEO 70/31.08.2023 amending and/or supplementing certain regulatory acts in the field of public pensions state:

Article I

Law no. 263/2010 on the unitary public pension system, published in the Official Gazette of Romania, Part I, no. 852 of 20 December 2010, as subsequently amended and supplemented, is amended and supplemented as follows:

1. In Article 29, paragraphs (11) and (12) are amended and shall read as follows:

(11) Workplaces classified under special working conditions on the basis of endorsements whose validity was extended until 1 September 2023 are workplaces under special working conditions, according to the law, until the employer has normalized the working conditions.

(12) The period of activity carried out in the workplaces referred to in para. (11) constitutes a contribution period under special working conditions, for which employers owe the 4% contribution pursuant to the provisions of Art. 138(b) of Law no. 227/2015 on the Fiscal Code, as subsequently amended and supplemented.
